Learned counsel for the plaintiff states that the defendant is believed to have died in the first week of June, 2023. He states however despite plaintiff's best endeavor; they have been unable to bring the legal representatives of the deceased defendant on record till date. 2.

He states that details of the name of the son of the deceased defendant have been obtained, however, the address is not available and therefore an application for impleading the legal representatives have not been filed. 3.

In view of the facts noted above, in the absence of legal representatives of defendant being brought on record, as per Article 120 of the Schedule to Limitation Act, 1963 after 90 days of the death of the defendant, the suit has abated by the operation of law. Consequentially, the present suit is disposed of as abated.

Pending applications stands disposed of.
