% 29.01.2018 The petitioner has filed the present petition being aggrieved by the fact that its application for grant of recognition for conducting Diploma in Elementary Education, was rejected on the ground that a negative recommendation had been given by the State of Haryana. Learned counsel for the petitioner submits that, the said rejection by the respondent was illegal and arbitrary as the same overlooks the vital fact, that the petitioner‟s application was made much prior to the imposition of ban by the State of Haryana.

Ms.Arora, learned counsel for the respondent/NCTE, submits that in view of the fact that the initial application was submitted by the petitioner, prior to the imposition of ban on 16th September, 2016, the respondents have taken a considered decision to process the

application of the petitioner irrespective of the ban and states that the said application would be considered on merits expeditiously. In view of the admitted position that 3rd March, 2018 is the last date for grant of recognition for the Academic session 2018-19, it is expected that the respondents will take a considered decision in respect of the petitioner‟s application before the said date.
