By virtue of the present petition under Article 226 of Constitution of India Constitution read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioner seeks direction to the respondent to release the petitioner on parole for a period of four weeks. 2.

Though learned counsel for the petitioner has relied upon the order dated 23.01.2026 passed by this Court in CRL.M.A. 2542/2025 in W.P.(CRL) 3009/2026, whereby the applicant was given liberty to file a fresh application for grant of parole before the Jail Authority, however, since no such application has been moved by him, he seeks to withdraw the present petition with liberty to move an appropriate application within a period of three days in accordance with law.
