This is a petition under Article 227 of the Constitution of India seeking directions to the learned Chief Metropolitan Magistrate (CMM), Central District, Tis Hazari Courts to pass an order thereby appointing the receiver to take physical possession of the property bearing No. 1, Plot No. 1 (measuring 391 sq. Mr.Siddharth Chopra, the learned counsel for the petitioner submits that as of now the petitioner would be satisfied in case the direction is issued to the learned Chief Metropolitan Magistrate to dispose of the application filed under Section 14 of the SARFEASI Act, 2002 by the next date listed before the Court of Chief Metropolitan Magistrate, i.e., 12.02.2025. 3.

The petitioner has filed an application under Section 14 of the SARFAESI Act 2002, which is stated to be pending before the learned Chief Metropolitan Magistrate since last one year.

In terms of Section 14 of the SARFAESI Act 2002, the learned Chief Metropolitan Magistrate is obliged to decide the application filed under Section 14 of the Act within 30 days from the date of filing of the application and in any case, not exceeding 60 days. 5.

Keeping in view, the timeline stipulated and the fact that such application is pending since last one year, the learned Chief Metropolitan Magistrate is directed to take up the application on top priority and make all endeavour to expeditiously dispose of the same by the next date, i.e., 12.02.2025.
