% 15.11.2019 Pursuant to the direction passed by this Court, status report has been filed wherein it is stated that as per the FSL report No. SFSL-DLH/10245/QD/1127/19/18199 dated 31.10.2019, it was opined that "the person who wrote the red enclosed signatures stamped and marked S1 to S6 and A1 to A6 did not write the red enclosed signatures similarly stamped, and marked Q1 to Q6". However, these documents have been sent again to FSL vide memo diary No.-3837/SHO/Aman Vihar dated 13.11.2019 for further necessary examination with required queries.
Though the anticipatory bail application of the petitioner has been dismissed vide order dated 01.10.2019 and learned counsel appearing on behalf of the petitioner submits that he purchased property (plot) through complainant, who is a property dealer, in the 2003. Thereafter, constructed the said property and thereafter sold in
the year 2018 to one Lalit Jha R/o H.No. 303, Block W, Shiv Durga Mandir, Prem Nagar-II, Delhi and thereafter he has nothing to do with this property. The property in question is Khasra No. 4/25, area measuring 40 Sq. Yds, Plot No. 169, Abadi known as Adarsh Enclave, Laxmi Vihar, Prem Nagar-III, Mundka.
However, in Civil Suit No. 14674/2011 for permanent injunction qua property No. is Plot No. 169 measuring 40 Sq. Yds, in the Revenue State of Mundka, Delhi known as Adarsh Enclave, Laxmi Vihar, Mundka, Delhi between Dharamvir and Ravinder Paswan (the petitioner herein), in the said suit, the petitioner has stated before the Court on 24.04.2012 that the respondent (the petitioner herein) stated that he has nothing to do and he is neither owner nor legal right for the said property.
SI Sumit, IO of the case, is present in the Court and shall verify the property in question in this case and the property mentioned in the suit whether both the properties are the same and file the status report three before the next date of hearing.
The Director, FSL, Rohini is directed to examine the documents sent by Police Station Aman Vihar on 13.11.2019 within one week from the receipt of this order. The IO of the case is directed to collect report from the said FSL and file alongwith the status report. Renotiy on 16.12.2019.
Though the anticipatory bail application of the petitioner has already been dismissed, however keeping in view the fact mentioned above, I hereby direct the IO of the case not to take any coercive steps against the petitioner till the next date of hearing.
The petitioner shall join investigation as and when required by the IO.
