O R D E R

% 28.03.2026 The matter is listed today i.e., 28.03.2026 since 02.03.2026 was declared a holiday.

By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioners and respondents Nos.2 to 5, seek quashing of case FIR No.764/2024 dated 21.11.2024 registered under sections 110/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 ('BNS') at P.S.: Bawana, Outer North District, Delhi. 3.

The petition is premised on Deed of Settlement dated 24.12.2024, whereby the petitioners and respondents Nos. 2 to 5 have resolved the matter amicably.

The petition is also supported by affidavits of the petitioners and of respondents Nos. 2 and 3, alongwith proof of their IDs. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Considering that respondents Nos. 4 and 5 were impleaded at a subsequent stage, their statement dated 28.05.2024 recorded before the learned Joint-Registrar shows that that they also do not wish to pursue the subject FIR.

The main contesting parties are present in court. Their credentials have been verified and they have also been identified by their respective counsel.

The court has interacted with respondents Nos.2 and 3, as also with petitioners, who have confirmed that they have now resolved the matter and Deed of Settlement dated 24.12.2024 has been signed by them closing all issues amicably. Parties now wish to live in peace and harmony going forward.

Mr. Amol Sinha, learned ASC (Criminal) confirms that the State has no objection to the subject FIR being quashed.

In the circumstances, in line with the law laid down by the Supreme Court in Gian Singh vs. State of Punjab & Anr. reported as (2012) 10 SCC 303 as also in Narinder Singh & Ors. vs. State of Punjab & Anr. reported as (2014) 6 SCC 466, this court sees no reason why the subject FIR and all proceedings emanating therefrom should not be quashed. This court is of the view that in light of the settlement between the contesting parties, continuing with the subject FIR and all subsequent proceedings would be an exercise in futility and would not be conducive to peace and harmony between the parties.

While allowing the petition however, this court considers it appropriate, that by way of atonement, each of the petitioners shall pay costs of Rs.15,000/- each to the 'Very Special Arts India', Plot No. 3 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

11. Subject to the aforesaid condition, FIR No. 764/2024 dated 21.11.2024 registered under sections 110/351(2)/3(5) of the BNS at P.S.: Bawana, Outer North District, Delhi is quashed. All proceedings arising therefrom also stand closed.

12. Petitioners are directed to place on record the proof of payment of costs 01 week thereafter.

13. The Registry is directed to re-list the matter if costs are not paid as directed.

14. Petition stands disposed-of.
