O R D E R

The petitioner has filed the present petition, inter alia, impugning an order dated 02.09.2019, whereby the petitioner's application for being released on parole was rejected.

The petitioner has been convicted of an offence punishable under Section 20(c) of the Narcotics, Drugs and Psychotropic Substances Act, 1985 and was sentenced to serve ten years rigorous imprisonment. He was also imposed a fine of ₹1 lakh. The petitioner's appeal (Crl. Appeal No.785/2014) against his conviction was dismissed by an order dated 22.02.2019, passed by this Court.

It is seen that the petitioner has been in custody for eight years three months sixteen days as on 16.09.2019.

Thus, as of today, the petitioner is required to serve a further period of one year and three months

approximately.

The petitioner has never been released on a furlough or parole on any prior occasion.

He has sought parole for filing a Special Leave Petition against the order dated 22.02.2019 passed by this Court, dismissing his appeal.

Considering the circumstances, this Court considers it apposite to allow the present petition.

The petitioner is directed to be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond of ₹10,000/- with one surety of an equivalent amount to the satisfaction of the concerned Jail Superintendent.

The petitioner shall provide his contact details including a mobile number and ensure that he is reachable at all times.

Immediately on his release, the petitioner shall mark his presence before the concerned police station and continue to do so on every Monday of the calendar week till his surrender on completion of the period of parole. 6.

The petition is disposed of in the aforesaid terms. 7.

This order be communicated to the petitioner through the concerned Jail Superintendent.
