O R D E R

% 25.11.2019 Status report and Nominal Roll in respect of convict Jagan Nath have been filed.

No one is present on behalf of the petitioner. This is a writ petition for quashing of the order dated 25.07.2019 and for release the petitioner on furlough for the period of three weeks and for deposit of cash surety in lieu of surety bound. As per status report, the application of the petitioner for furlough was declined by Officer of the Director general (Prison), Prison Headquarter, Tihar, New Delhi on 25.07.2019 on the ground that 'His last mulakat with family/friend was done on 02.07.2019." It is further submitted in the status report that petitioner has provided the address i.e. H.No. 814, Gali No. 11, 1st Pusta Sonia Vihar, Delhi where he will stay.

However on inquiry, the said premises was found locked. Further, inquiries were made from native place of the petitioner i.e. VillageBasant Pur, PO Simrota, PS Shivratan Ganj, District Amethi, U.P. where younger brother of the petitioner namely Sh. Shri Krishan was found residing there and submitted that he is ready to give surety of petitioner Jagannath.

In view of the above status report since younger brother of the petitioner is ready to stand surety for the petitioner, the prayer for cash surety in lieu of surety bond is dismissed.
