The present petition has been filed under Section 15 of the Arbitration and Conciliation Act, 1996 [hereinafter 'the Act'] for termination of mandate of learned Arbitrator and to appoint a substitute Sole Arbitrator. 2.
Mr. Rohit Kumar Poddar, learned counsel appearing on behalf of the petitioner submits that earlier the petitioner had filed an application under Section 11 of the Act which was registered as ARB. P. 47/2025 and was allowed by this Court vide order dated 25.08.2025. 3.
Consequently, Mr. Sukhdev Singh (retired ADJ) was appointed as Sole Arbitrator to adjudicate the disputes between the parties. The arbitration was to be held under the aegis of Delhi International Arbitration Centre [in short, 'DIAC'], Delhi High Court.

The said Arbitrator requested the DIAC for termination of his appointment. Accordingly, the parties were informed by the DIAC with regard to such request having been made by the Arbitrator appointed by this Court.

Mr. Manthan Dixit, learned counsel appearing on behalf of the respondent submits that he has no objection in case the mandate of the previous Arbitrator namely, Mr. Sukhdev Singh (Retd. ADJ) is terminated and substitute sole Arbitrator is appointed.

Accordingly, the present petition is allowed. 8.
The mandate of the previous Arbitrator namely Mr. Sukhdev Singh is terminated.

Accordingly, Ms.
Aaliya Waziri, Advocate [Enrolment No.D/1547/2020] [Mobile no.9971963729] is appointed as Arbitrator. 10.
The arbitration will be held under the aegis of DIAC, Delhi High Court, Shershah Road, New Delhi-110503, and will be governed by the Rules of DIAC, including as to the remuneration of the learned Arbitrator. 11.
The learned Arbitrator is requested to furnish declaration under Section 12 of the Act, prior to entering upon the reference. 12.
It is clarified that no observation has been made on merits of the case and all the contentions available to the parties are left open for adjudication by the learned Arbitrator.
