It is submitted that Respondent No.2 who is present in the Court has not been appearing in the Trial Court and is also not abiding by the MOU dated 02.03.2017. Consequently, the criminal trial is ongoing despite there being a Settlement inter-se the parties.

Learned counsel along with Respondent No.2 submits that the Settlement dated 02.03.2017 has not been complied with in entirety and consequently she is not inclined for quashing at this stage. 3.

After some arguments learned counsel for the Petitioner seeks permission to withdraw the present Petition to seek an inter-se Settlement between the parties before the Trial Court and liberty is sought to file fresh Petition, if need be.
