Petitioner seeks initiation of contempt proceedings against respondents for not complying with the specific directions contained in order dated 02.09.2024 passed by learned Division Bench of this Court in W.P.(C) 12057/2024 whereby the writ petition was disposed of as not pressed with liberty to the petitioner to approach the respondents by way of appropriate representation within a period of four weeks. Simultaneously, the respondents were directed to decide such representation within a period of eight weeks from the date of receipt thereof.

According to the petitioner, immediately thereafter i.e. on 03.09.2024, he sent representation to the concerned Bank as well as to Commandant of 73 BN BSF by sending a scanned copy of the representation but he has yet not heard anything from the side of the respondents.

Learned counsel for respondent Nos.1, 2 and 3 appears on advance notice. It is submitted that the matter is under active consideration and final decision with respect to the representation in question shall be taken within a period of six weeks. It is also submitted that the matter is little complex as there are two schemes which are involved in the present matter and certain inputs are also to be taken from the concerned Bank. Such statement is made on specific instructions.

In view of the above, learned counsel for the petitioner submits that the petitioner, at the moment, does not press his contempt petition. 5.

The petition is, accordingly, disposed of as not pressed, particularly, in view of the above said assurance given by learned counsel for the respondents.

Needless to say, in case, nothing is done by the respondents within the aforesaid period of six weeks, as undertaken above, the petitioner would be at liberty to revive the present contempt petition by moving appropriate application.
