The challenge in the petition is to the order-in-original dated 07th November 2025 passed by the respondent no.3 whereby the prayer for refund of amount of Rs. 57,72,889/- came to be rejected. 2.

Learned counsel appearing for the petitioner states that the petitioner has submitted all the relevant documents in support of claim for refund which the respondents not only have failed to consider, but have also failed to offer the opportunity of hearing.

Learned counsel for the respondent, in response to the above, states that the Court may pass an appropriate order and, if so required, by The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. remanding the matter back by granting opportunity of hearing to the petitioner.

That being so, we deem it appropriate to partly allow the present petition by quashing the order impugned dated 07th November 2025. 5.

We restore the proceedings to the file and we permit the petitioner to appear before the competent authority on 09th February 2026 at 11:00 AM. 6.

The competent authority shall grant hearing to the petitioner and decide the claim expeditiously and in any case within a period of twelve weeks thereof.

Needless to say that on the date of hearing it is open for the petitioner to furnish the copies of the replies along with documents physically.
