The Writ Petition under Article 226 of the Constitution of India read with Section 528 BNSS has been filed for quashing of the FIR No.126/2022, P.S. EOW, under Sections 408/420/120B IPC qua the Petitioner. 2.

Issue notice.

Learned APP accepts Notice on behalf of the State. 4.

It is submitted in the Petition that the Petitioner was an employee of the Respondent Company and they have amicably settled all the disputes for which the Petitioner has paid Rs.30 lakhs to the Complainant which has been duly accepted by the Complainant, who has also given an undertaking to not continue, pursue or file any fresh criminal, civil litigation against the Petitioner.

Statements of the parties in terms of the Settlement dated 05.08.2024 has already been recorded by the learned Joint Registrar. 6.

The learned Prosecutor on instructions from the IO submits that a draft Chargesheet has been prepared in which only the Petitioner has been found to be the accused.

Considering the nature of allegations and the settlement between the parties, FIR No. 126/2022, P.S. EOW, under Sections 408/420/120B IPC is hereby quashed along with all the proceeding emanating therefrom. 8.

The Petition is accordingly disposed of.
