The Petitioner has approached this Court challenging the Order dated 17.12.2021, passed by the Deputy Commissioner of Police, South District, rejecting the first appeal application of the Petitioner under the Right to Information Act, 2005.

Section 19 of the Right to Information Act, 2005 provides for an appeal to the CPIO against an Order passed by the First Appellate Authority before the CIC.

This Court on 13.01.2022 had directed the Petitioner to file an affidavit giving out the details of the various RTI applications which form the subject matter of the appeal, in order to enable this Court to consider whether the Writ Petition would be maintainable in view of the fact that the petitioner has an alternate remedy in the nature of a second appeal before the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The said Order has yet not been complied with. 5.

Since an alternate and efficacious remedy is available to the Petitioner, this Court is not inclined to entertain the present Writ Petition. The Writ Petition is dismissed along with the pending applications, if any. 6.

It is always open for the Petitioner to avail the alternate remedy available to the Petitioner under Section 19(3) the Right to Information Act, 2005.
