% 01.03.2017 Caveat No.56/2017 Since counsel for respondent has entered appearance, caveat stands discharged.

RC.REV. 22/2017 & CM No.2071/2017 I have heard arguments of learned counsel for the petitioner. At this stage, learned counsel for the petitioner on instructions from the petitioner who is present in person states that the petitioner would like to settle the matter with the respondents if some time is granted to the petitioner to vacate the property, the petitioner would not press this petition. After some submissions it has been agreed that the petitioner shall vacate and hand over vacant physical possession of the tenanted property bearing No.1848, Chowk Sui Walan, Daryaganj, Central Delhi-110002 as described in the Eviction Petition on or before 31.01.2019. RC.REV.22/2017

The petitioner shall file an affidavit undertaking to do the same within three weeks from today. In the affidavit he shall also undertake to pay the agreed rent of Rs.400/- per month by the 7th day of each month. He will also pay the arrears of rent, if any, within two months from today. He will also undertake to pay the electricity and water charges for the premises in question. He will also undertake not to sublet the property or induct any third party in the property or cause wilful damage to the property. In view of the above, learned counsel for the petitioner submits that he does not wish to press the present petition. Subject to the petitioner filing an affidavit with an advance copy to learned counsel for respondents within two weeks, learned counsel for respondents submits that respondents shall not execute the eviction order till 31.01.2019.

Petition stands disposed of. All pending applications, if any, also stand disposed of.
