This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayer(s):- "a) Issue a writ in the nature of Mandamus directing the Respondent Bank to grant authorization to the Petitioners herein to access/operate the Pension account bearing NO 90632030000510 Branch Canara Bank Head Quarters Vayu Bhawan New Delhi 110011 of their father in lieu of his medical condition which is deteriorating day by day;and"

The brief facts are that the present petition is filed in the name of Air Vice Marshal C.R.Ghosh (Retd.) through his legal heirs i.e., his daughters. The Air Vice Marshal C.R. account in the respondent Bank.

On 21.11.2025, the petitioners wrote a letter seeking authorization from the respondent Bank for access to the pension account in lieu of Air Vice Marshal C.R. Ghosh (Retd.) serious medical condition. In response to the same, the respondent Bank gave a legal opinion dated 04.12.2025 including ways which can be undertaken in order to get the requisite authorization.

Mr. Sharma, learned senior counsel for the petitioner, states that the Air Vice Marshal C.R. Ghosh (Retd.) is suffering from Parkinsons and Dementia and his daughters have already put him into Epoch Eldercare assisted Facility named "Frida House", which is a facility meant for assisted living.

The case of the daughters of Air Vice Marshal C.R. Ghosh (Retd.) is that there are sum lying in the pension account of their father, which is maintained with the respondent Bank and that the respondent Bank is not permitting the release of funds which are required care and needs of the Air Vice Marshal C.R. Ghosh (Retd.). 6.
I am of the view that the matter requires consideration. 7.
For the said reasons, issue notice.

Mr. Bansal, learned counsel accepts notice on behalf of the respondent.

Mr. Sharma, learned senior counsel for the petitioner, states that even though there is no interim application, there is urgent need of funds as the same is required for the care of the Air Vice Marshal C.R. Ghosh (Retd.).

I am of the view that the money belongs to the Air Vice Marshal C.R. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Ghosh (Retd.) and the money is required to be used for his benefit. 11.
The guardianship certificate shall take some time and if the funds are not utilized in the time of need, the funds would be irrelevant and of no use.

For the said reasons, it is directed that the bill raised by Epoch Elder Care Pvt. Ltd. shall be sent to the petitioner's legal heirs, who shall after due verification forward the same to the respondent Bank and the respondent Bank shall make payment directly to the Epoch Elder Care Pvt. Ltd. within one week from receipt of the bills. 13.
In this view of the matter, Mr. Sharma, learned senior counsel for the petitioner, states that no further grievance survives. 14.
