BAIL APPLN. 353/2024 2.

This application has been filed by the applicant seeking release on interim bail for a period of 7 days in FIR No. 191/2021 registered at Police Station: Bara Hindu Rao, North, Delhi, under Sections 302/307/120B/34 of the Indian Penal Code, 1860 (in short, 'IPC') and under Sections 25/27/54/59 of the Arms Act, 1959 (in short, 'Arms Act') on the ground that the marriage of the brother-in-law of the applicant is fixed for 02.02.2024.

The applicant has been in custody since 12.08.2021. He was earlier released on interim bail on 10.04.2023 and had duly surrendered on 15.04.2023. The fact of the marriage has been verified by the police.

In order to enable the applicant to maintain the social ties while the trial is pending, and keeping in view his past conduct when released on interim bail on previous occasion, the applicant is directed to be released on interim bail till 05.02.2024 in FIR No. 191/2021 registered at Police Station: Bara Hindu Rao, North, Delhi under Sections 302/307/120B/34 of the IPC and under Sections 25/27/54/59 of the Arms Act on furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount subject to the satisfaction of the learned Trial Court/Duty MM, further subject to the following conditions:

i.

Applicant shall not leave Delhi/NCR without prior permission of the Court;

ii.

Applicant shall provide permanent address to the learned Trial Court. Applicant shall inform the IO and the Jail Superintendent the address where he shall be available in Delhi/NCR.

iii.

Applicant shall appear before the Court as and when the matter is taken up for hearing.

iv.

Applicant shall provide all mobile numbers to the IO concerned which shall be kept in working condition at all times and shall not switch off or change the mobile number without prior intimation to the IO concerned. The mobile location be kept on at all times.

vi.

Applicant shall not indulge in any criminal activity and shall not communicate with or come in contact with any of the prosecution witnesses, the victim/complainant or The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

vii.

The Applicant shall surrender on or before 05.02.2024. 5.
