O R D E R

The petitioner has filed the present petition, inter alia, praying that FIR bearing No. 300/2013 under Sections 420/406 of the IPC registered with PS Subhash Place and all proceedings emanating therefrom, be quashed.

The said FIR was registered at the instance of respondent No.3. Respondent no. 3 is present in Court and is identified by the Investigating Officer. Respondent No. 3 confirms that he and his father (respondent No.

2) have resolved all their disputes with the petitioner in terms of two Memorandums of Settlement.

Copies of the counterparts of the said Memorandums of Settlement have been annexed with the present petition. Respondent No.3 states that he has already received a sum of ₹2,50,000/- and on further receipt of ₹25,000/-, neither he nor his father would have any

grievance against the petitioner and all their claims will stand fully satisfied. A bank draft for a sum of ₹25,000/- has been handed over to respondent No. 3 and he has accepted the same in full and final settlement of all his claims as well as the claims of his father.

The learned counsel appearing for the petitioner states that the petitioner could not be present in Court as she is a widowed lady and is of an advance age. Her personal presence is, therefore, exempt. 4.

In view of the statements made on behalf of the petitioner as well as respondent Nos. 2 and 3, this Court considers it apposite to allow the present petition.

Accordingly, FIR bearing No.300/2013 under Sections 420/406 of the IPC registered with PS Subhash Place and all proceedings emanating therefrom, are quashed.

Respondent No.3 shall sign this order as an acknowledgement of his statement recorded herein.
