% 22.01.2018 Counsel for the petitioner fairly concedes that a similar issue was raised by them in Writ Petition (C) No. 203/2018, International Fasteners Through Its Proprietor versus Commissioner of Customs (Export), which was disposed of vide order dated 11th January, 2018, as not entertained without expressing any opinion on merits giving liberty to the petitioner to file an appeal before the Commissioner (Appeals). In view of the accepted position, the present writ petition is also not entertained for the reasons stated in the order dated 11th January, 2018 in the case of International Fasteners (supra).

In case an appeal is filed within next seven days before the Commissioner (Appeals), the same would not be dismissed on the ground of limitation.
