BAIL APPLN. 375/2025 3.
An Application under Section 439 read with Section 482 of Cr.P.C has been filed on behalf of the Applicant seeking further extension of Interim Bail for a period of one month to facilitate proper treatment. 4.
Learned counsel for the Applicant submits that now the date for surgery has been fixed for 12.02.2025 and thus, the bail may be extended. 5.
The learned Prosecutor has opposed the Bail on the ground that though 15 days Interim Bail was granted on 23.09.2024, the Bail Bond was The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. furnished only subsequently and the period of 15 days ended on 22.12.2024. Even thereafter, extensions have been taken on behalf of the Petitioner. As has been observed by learned ASJ, the surgery has already been done on 13/15.01.2025 and it was for Kidney Stones. It was further observed that the Application for Interim Bail shall be considered only after the Applicant surrenders in the Jail. There is no merit in the Petition 6.
Submissions heard and record perused.

Learned ASJ while declining further extension beyond 29.01.2025 has noted that the surgery performed was for Kidney Stones which has been done on 13/15.01.2025. The next surgery is planned after four weeks for which the time is not fixed.

Learned counsel for Applicant submits that the date of surgery has now been fixed on 12.02.2025.

Considering the nature of ailment, there is no infirmity in the Order of the learned ASJ.

The Applicant may surrender himself and seek further interim bail before the learned ASJ in case he is able to establish justifiable grounds. 11.
The Application stands disposed of.
