By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, read with Section 482 of the Code of Criminal Procedure, 1973, the petitioner seeks quashing of FIR No.458/2023 dated 27.11.2023 registered under Sections 279/337/304A of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

the Indian Penal Code, 1860 and Section 185 of the Motor Vehicles Act, 1988 at PS: Hari Nagar, Delhi, and all proceedings emanating therefrom, in view of the settlement arrived at inter se the petitioner and the respondent nos.2 and 3, as recorded in the order dated 04.12.2025 passed by the learned District Judge-cum-PO: MACT, West District, Tis Hazari Courts, Delhi.

The present petition is accompanied by the said order dated 04.12.2025 [Annexure P3] alongwith the affidavits and respective proofs of identity of the petitioner and the respondent nos.2 and 3. 3.

Issue notice.

Learned APP for the State accepts notice, and submits that she has no objection to the quashing of the aforesaid FIR No.458/2023 dated 27.11.2023.

Respondent nos.2 and 3, who are present in Court, also accept notice. Respondent nos.2 and 3, who are parents of the deceased, affirm the settlement recorded in the aforesaid order dated 14.12.2025 and submit that they have voluntarily settled all their disputes with the petitioner. Respondent nos.2 and 3 further state that they have received an amount of Rs.15,00,000/- out of the total settlement amount of Rs.45,00,000/-. Today, learned counsel for the petitioner has handed over DD No.308 dated 20.01.2026 of Rs.30,00,000/- (HDFC Bank) to the respondent nos.2 and 3. It is further stated that they do not wish to pursue the criminal proceedings against the petitioner and have no objection to the quashing of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The petitioner as also respondent nos.2 & 3, who are present in Court, have been identified by the IO, as also their credentials have been verified.

In view of the fact that a settlement has already been arrived at between the petitioner and respondent no.2 & 3 as such, following the law laid down by the Hon'ble Supreme Court in Gian Singh vs. State of Punjab & Anr. (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. (2014) 6 SCC 466, this Court is of the opinion that continuation of the aforesaid FIR No.458/2023 dated 27.11.2023 will be an exercise in futility.

Accordingly, the present petition is allowed and FIR No.458/2023 dated 27.11.2023 registered under Sections 279/337/304A of the Indian Penal Code, 1860 and Section 185 of the Motor Vehicles Act, 1988 at PS: Hari Nagar, Delhi and all other proceedings emanating therefrom are hereby quashed.

At this stage, the petitioner, who is a Pilot with Air India, as a grateful gesture towards Society volunteers to contribute Rs.15,000/- per month for a period of one year commencing from February, 2025 to the "Delhi Police Welfare Society Fund [Account No.18200100001081 and IFSC Code-UCBA0001820]".

Let the same be done for a period of one year commencing from February, 2025.

This Court appreciates the above bona fide gesture of the petitioner. 12.

Accordingly, the petition alongwith pending application is disposed of.
