This petition has been filed by the petitioners challenging the Order dated 11.08.2023 passed by the learned Central Administrative Tribunal, Principal Bench, New Delhi (hereinafter referred to as the, 'Tribunal') in O.A. No. 4007/2017, titled Mohit v. Govt. of NCT of Delhi Through its Secretary & Ors., allowing the O.A. filed by the respondent herein in terms of its earlier Order dated 10.08.2023 passed in O.A. No. 2421/2018, titled Yogesh Sharma & Ors. v. GNCT of Delhi & Ors..

The Order dated 10.08.2023 passed by the learned Tribunal became a subject matter of challenge before this Court in Govt. of NCT Delhi & Ors. v. Arun Singh Bhatti, 2024 SCC OnLine Del 8262.

This Court in Arun Singh Bhatti (supra), on a detailed consideration of the facts and the submissions, had set aside the Order of the learned Tribunal observing that the Courts cannot declare on equivalence of the educational qualification, and the same must be considered by competent institutions/organisations such as, UGC, AICTE, etc. The Court also found that the learned Tribunal has, in fact, re-written the eligibility clause in the Recruitment Rules and the Advertisement. The Court further held that the learned Tribunal, in fact, had framed an erroneous issue for determination in the Impugned Order therein.

Keeping in view the above, we are also unable to sustain the Impugned Order passed by the learned Tribunal. The same is, accordingly, set aside.

The petition is disposed of.
