% 05.03.2020 MAT.APP.(F.C.) 263/2019 and C.M. No. 44976/2019 (by the appellant under Section 151 CPC for stay) and C.M. No. 44977/2019 (Exemption) 1.

Learned counsel for the appellant states that on the last date of hearing, he was directed to file the list of witnesses to demonstrate that he had cited the two persons, who the appellant had claimed, had seen his wife/respondent No.1 in an adulterous relationship. 2.

Today, learned counsel concedes that neither of the two persons referred to in para 2 of the order dated 14.10.2019, passed in the present appeal, were cited as witnesses by the appellant. He further states on instructions that instead of pressing the present appeal on merits, having regard to the fact that the parties have been living separately for the past fifteen years, he does not wish to press the appeal on merits and instead, MAT.APP.(F.C.) 263/2019

requests that a limited notice may be issued to the respondent No.1/wife on the aspect of the parties exploring the possibility of arriving at a one-time negotiated settlement.

Accordingly, the present appeal and the applications are disposed of as not pressed.

On the appellant filing the process fee, a limited notice on the aspect of the parties exploring the possibility of arriving at a one-time negotiated settlement be issued to the respondent No.1/wife directly, as also through the counsel appearing for her before the Family Court, by ordinary process, speed post and courier, returnable on 31.7.2020.
