The petitioner's grievance seems to be that the regularization of the similarly situated quarters is being permitted by the respondents. Whereas, the regularization of the petitioner's quarter has been rejected. 2.

Learned counsel appearing for the respondent's points out from the order dated 20.09.2022, regarding quarter No.821, Type II, Sector-3, R. K. Puram, New Delhi 110022, that on account of the retirement of the father of the applicant therein, the quarter was regularized. 3.

Learned counsel appearing for the respondent, on advance instructions, contends that in that case, within the same category of quarters The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the regularization was sought for, however, in the instant case, the petitioners occupies Type II quarter and is entitled for Type IV. 4.

The Court finds that Type IV seems to be a higher category than Type II. The petitioners abandon their claim for Type IV quarter and prefer to stay in Type II. The petitioners' statement is taken on record. 5.

In view thereof, there does not seem to be any impediment in reconsideration of the petitioners' case.

Let the respondent to re-consider the case of the petitioner and to pass a fresh order after affording opportunity of hearing to the petitioners within a period of four weeks from the receipt of a copy of the order passed today. 7.

If the petitioners' grievance is not fully mitigated, the petitioner shall be entitled to take appropriate recourse in accordance with law. 8.

With the aforesaid observations, the petition stands disposed of.
