% 10.01.2020 This petition has been filed by the petitioner inter alia seeking expunction of observations against the petitioner in paragraph 5.13 of the final order dated 29.07.2019 passed by the Unlawful Activities (Prevention) Tribunal published by the respondent no.1 vide Gazette of India Notification No.S.O.3083 (E) dated 27.08.2019. It is the case of the petitioner that the said paragraph wrongly records that the petitioner is one of the 10 out of 12 accused who were convicted for being a member of SIMI by the Special Judge in Crime No.05/2006 registered by the Anti Terrorism Squad, Mumbai vide judgment dated 30.11.2015. It is asserted that the petitioner had in fact, been acquitted in the said trial by the order dated 30.09.2015. The respondent no.1 has filed an affidavit admitting that the insertion of the name of the petitioner in paragraph 5.13 was a typing error.

In view of the above, the name of the petitioner in paragraph 5.13 of the order dated 29.07.2019 passed by the Unlawful Activities (Prevention) Tribunal in Re: Students Islamic Movement of India shall be treated as expunged and the respondent shall publish a corrigendum in this regard in the Official Gazette. The petition is allowed in the above terms.
