Learned counsel for the appellant states that subsequent to the last date of hearing, the respondent No.3 has issued a fresh Show-Cause Notice to the appellant, to which it proposes to file a reply and in view of the said development, he has instructions not to press the present appeal, while reserving the right of the appellant to take all the pleas in the reply to the fresh Notice to Show-Cause issued by the respondent No.3. 2.

Leave as prayed for is granted. The appeal is disposed of as not pressed alongwith the pending applications.

It is however made clear that while taking a decision on the reply submitted by the appellant to the fresh Show-Cause Notice issued by the LPA 680/2019

respondent No.3, the Competent Authority shall pass a speaking order uninfluenced by the observations made in the impugned order dated 21.10.2019, passed in W.P.(C) 9749/2019.
