The petitioner, who is the defendant in the suit under Order XXXVII CPC before the learned Trial Court, is assailing the impugned order dated 05.01.2024, whereby, although the application for leave to defend under Order XXXVII Rule 3(5) CPC has been allowed, the petitioner has been called upon to make a deposit of Rs. 2 lakhs by way of Fixed Deposit in the court within fifteen days. 4.

Since the direction is only for investment in a fixed deposit, it does not prejudice the petitioner in any manner, There is no merit in the civil revision petition. The same is dismissed without prejudice. The pending application is also disposed of.
