This petitions has been filed with the following prayers:- "a) Issue a writ order or direction in the nature of certiorari thereby quashing and setting aside the order dated 18.06.2025 to the extent it requires the Petitioners to submit documents qua their retiral benefits at the age of 57 years. b) Issue a writ order or direction in the nature of Mandamus directing the Respondents to allow the Petitioners to continue in service till 60 years of age alongwith all consequential benefits.

c) Issue any other suitable writ, order or direction as this Hon'ble court may deem fit and proper under the circumstances of the case."

In effect, the case of the petitioner is that his service be continued till the age of 60 years instead of 57 years. The counsel for the petitioner has relied upon the judgment of the Coordinate Bench in the case of Bhim Singh Kothari & Ors. v. Union of India & Ors, in W.P.(C) 18671/2025 decided on 09.12.2025, wherein, the Court had decided to an identical issue which had come up before it by referring to the judgement in the case of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Cheeli J Ratnam v. Union of India, 2025 SCC OnLine Del 8573, wherein, it is held that the petitioner therein would be entitled to retire at the age of 60 years.

The counsel for the petitioner submits that the petitioner herein is similarly placed as the petitioners in the case of Bhim Singh Kothari & Ors. (Supra) and also Cheeli J Ratnam (Supra), inasmuch as, he is working as Commandant (junior grade), of which the retirement age is 57 years. 4.

The learned counsel for the petitioner submits that, as per his information, the respondents have not implemented the order passed by this Court in the cases of Bhim Singh Kothari & Ors. (Supra) and Cheeli J Ratnam (Supra), as the Court has granted three months time to the respondents to implement the same.

The, learned counsel for the respondents, on instructions, states that the decision has been taken to challenge the orders passed by the Coordinate Bench in the aforesaid cases before the Supreme Court. We are of the view as there is no stay as on date, for parity of reasons, this petition need to be allowed, holding that the petitioner shall be entitled to retire at the age of 60 years.

The petition is disposed of as allowed.
