The present petition under Section 11(6) of the Arbitration and Conciliation Act, 1996 seeks appointment of a Sole Arbitrator to adjudicate the differences and disputes between the parties arising out of the contract awarded to M/s Khan Traders vide office acceptance letter dated 22.03.2018.

Upon notice being issued, the respondent has filed a reply from which it is evident that there is no serious objection to the appointment of an Arbitrator, though it is claimed by the respondent that no amount is payable to the petitioner.

Accordingly, the petition is allowed and Mr.D.S. Paweriya, ADJ (Retd.) is appointed as the sole Arbitrator to adjudicate the disputes and difference between the parties.

The arbitration shall be conducted under the aegis of Delhi International Arbitration Centre (DIAC)

The learned Arbitrator shall ensure the compliance of Section 12 read with Fifth, Sixth, Seventh Schedule of Arbitration and Conciliation Act, 1996 before commencing the arbitration. 6.

The fee of the learned arbitrator shall be in accordance with the Schedule of fees prescribed under the Delhi High Court Arbitration Centre (Administrative Costs and Arbitrators' Fees) Rules. 7.

A copy of this order be sent to Delhi International Arbitration Centre (DIAC) 8.
