A Petition under Section 378(1) read with Section 482 Cr.P.C has been filed against the Judgment dated 07.03.2020 passed by the learned M.M who has acquitted Respondent No.2 for the offence punishable under Section 406/498A IPC. 2.
It has been submitted that since it was against the Order of the learned M.M, the Appeal should have been preferred before the Court of Sessions. 3.
Permission is sought by the Petitioner to withdraw the present Petition with liberty to file the Appeal before the Court of learned ASJ. 4.
In view of the submissions made, the Petition is allowed to be withdrawn with liberty to file it before the Court of Sessions in accordance with law. 5.
Needless to say that the time for which the Petition was pending in the High Court may be exempted while calculating the period of limitation. 6.
The Petition is disposed of accordingly.
