The Petitioner submits that he was pursuing his remedy under Section 42 of the East Punjab Holdings (consolidation and Prevention of Fragmentation Act, 1948) before the Financial Commissioner, GNCTD, in Case No. 15/2020. However, the said proceedings were withdrawn as the land in question came to be urbanised by a notification of the GNCTD, and consequently, the Financial Commissioner ceased to have jurisdiction to adjudicate the dispute.

In such circumstances, after making submissions for some time, counsel for the Petitioner seeks permission to withdraw the present petition with liberty to take recourse to appropriate civil proceedings, in accordance with law.
