% 14.12.2024 The appellants seek enhancement of compensation over and above what has been granted by the learned Tribunal vide award dated 19.12.2018.
Appellant No.p1 appeared in person and he has handed over the copy of the Adadhar Card and his PAN Card to establish his identification today in the Court. The copies of the same are taken on record.
We have interacted with the learned counsel/parties concerned. Apropos such interaction and due deliberation, the parties have agreed that respondent no.1/Insurance Company shall pay enhanced compensation Rs. 9,50,000/- over and above the compensation granted by the learned Tribunal to the appellant(s), towards full and final settlement. In view of the settlement arrived at between the parties, the respondent no.1/Insurance Company is directed to deposit the enhanced amount of compensation to the tune of Rs. 9,50,000/- before the concerned Tribunal within a period of five weeks from today, failing which the respondent shall be liable to pay interest @ 9% p.a. for the delayed period. The concerned learned Tribunal shall release the aforesaid amount alongwith interest, if any, to the appellant(s), as in such proportions as directed in the award, subject to verification and completion of requisite formalities.
The present appeal alongwith the pending application(s), if any, is disposed of in terms of the foregoing settlement A copy of this order be sent to concerned learned Tribunal with LCR, if requisitioned and received.
