The Petitioner seeks quashing of order dated 23.12.2022 (hereinafter 'impugned order') passed by Central Administrative Tribunal, Principal Bench, New Delhi (hereinafter 'CAT'), dismissing O.A. No. 2914/2017 filed by the Petitioner.

The Petitioner was appointed as Mate in the MCD in the year 1982. He resigned from the services on 10.02.2012 to contest MCD elections, which was accepted on 14.03.2012. Unfortunately, the Petitioner was not successful in election. He made a prayer to re-join the Department, which was rejected. Thereafter, he filed an O.A., which was dismissed by the impugned order. Admittedly, the Petitioner has already attained the age of superannuation, hence, he cannot be reinstated.

The learned counsel representing the Petitioner submits that a similar situated candidate has been reinstated. This Court has considered the submissions made. a Writ now, as the Petitioner cannot claim the reinstatement since he has already attained the age of superannuation. He has never worked at the post and therefore, even if succeeds in the petition, cannot be directed to be paid from the public money for the period without working.

Thus, there is no ground to interfere with the impugned order. The writ petition stands dismissed.
