The petitioner, vide the present petition under Articles 226 and 227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), seeks issuance of appropriate Writ, order and/ or directions for expeditious disposal of the application filed by the petitioner under Section 125 of the Code of Criminal Procedure, 1973 (Cr.P.C.) in case bearing number MT No. 26/2024, pending before the learned Judge, Family Court-01, South-West District, Dwarka Courts, New Delhi (Family Judge).

considering the nature of the proceedings involved, he does not wish to file any reply.

In view the nature of the proceedings involved and the reliefs sought by the petitioner in the present petition, it is deemed appropriate to dispense with the issuance of notice to the respondent no.2. 5.

Further, considering the application under Section 125 Cr.P.C. was filed by the petitioner way back on 09.01.2024 and till today the interim maintenance is yet to be decided, as also keeping in view that the nature of the proceedings are arising out of a matrimonial dispute inter se the husband and wife, it is felt appropriate and in the interest of justice and both parties to call upon the learned Family Judge to make all endeavours to adjudicate upon MT No. 26/2024 as expeditiously as possible, preferably within a period of four months from the day of the present order, albeit, considering the current roster and board position. 6.

Irrespective, for a successful adjudication thereof, both parties involved therein are directed not to seek any unnecessary adjournment during the said period.
