O R D E R

Applicant seeks interim bail in FIR No. 289/2023 dated 28.05.2023, for commission of offences under Sections 365/376/506 of IPC, registered at P.S. Parshad Nagar.

The reason assigned in the bail application was to the effect that his mother was unwell and hospitalized and in state of coma. 3.

However, it has now been apprised that the mother of the applicant has breathed her last, yesterday itself.

I.O. is present and verifies the facts that the mother of the applicant has died yesterday, while admitted in the above hospital. 5.

subsequent development, may be considered and applicant be released on bail for a period of 15 days at least, to attend his mother's last rites. 6.

Complainant is present in Court.

Applicant is in custody for last around 31 months and all the public witnesses, including the prosecutrix, have already entered into the witness box.

Keeping in mind the fact that the applicant has lost his mother yesterday and being son, at this moment of grief, in order to permit him to meet other relatives and to attend her last rites and other ceremonies and without making any observation on the merits of the case, the applicant is enlarged on interim bail for a period of 15 days on his furnishing personal bond in a sum of Rs. 20,000/- with one surety of like amount subject to the satisfaction of learned Trial Court/CMM/Duty Magistrate. 9.

The period would be reckoned from the date he is released from the jail. During such period, the applicant would not come in contact with the complainant or her relatives in any manner whatsoever, and would surrender in the jail immediately after expiry of the abovesaid period of 15 days. 10.

The application stands disposed of in aforesaid terms 11.

Pending application also stand disposed of in aforesaid terms. 12.

A copy of this Order be sent to the Jail Superintendent for information and necessary compliance.
