After arguments, this appeal is disposed of with the consent order that the respondent will pay to the appellant a sum of Rs.2 lacs with interest at 6% per annum from 18.5.2008 within a period of four months from today and on such amount being received by the appellant, the same will be in full and final satisfaction of all claims of the parties against each other. It is however clarified that in case the amount in terms of today's order is not paid within four months then the rate of interest being 6% per annum will become 12% per annum.

Since the appellant/plaintiff/buyer had deposited an amount of Rs.20

lacs in this Court in terms of an order passed by a learned Single Judge of this Court when the suit was pending in this Court, whatever has been deposited by the appellant in this Court in the suit being CS(OS) 2197/2008 will be paid by the Registry of this Court to the appellant alongwith accrued interest within a period of six weeks from today. 3.

The appeal is disposed of accordingly.
