% 31.01.2017 Petitioner claims to be vending behind Shop no.101, Main Market, Sarojini Nagar, New Delhi. Sample copies of challans have been placed on record. Counsel for the petitioner submits that since the petitioner has been removed, serious prejudice has been caused to his rights because as and when a survey is conducted and in case petitioner is not found at the site, the petitioner would not be granted a licence. Mr. Peechara submits that the name of the petitioner does not find mentioned in the list of 628 vendors. The petitioner is not present at the site. However, Mr. Peechara submits that merely because the petitioner is not found present at the site, it does not mean that the case of the petitioner would not be considered by the Town Vending Committee (TVC) and the fear is unfounded, as upon the petitioner filling up the requisite form and enclosing supporting documents, the TVC would consider the case of the
petitioner in accordance with law.
The petition is disposed of in above terms.
CM.APPL 770/2017 also stands disposed of.
A copy of the order be given Dasti to the counsel for the parties. G.S.SISTANI, J VINOD GOEL, J JANUARY 31, 2017 pst / W.P.(C) 164/2017 2/2
