% 22.03.2017 Impugned judgment of 27th September, 2008 directs that respondent-plaintiff would be entitled to agreed amount of rent and common service charges when the vacant possession of the suit land is handed over and also to differential amount of rate of rent and common service charges by respondent during the period 13th February, 2004 to 12th September, 2007.

Learned counsel for respondent-plaintiff submits on instructions that an execution petition [Ex.P.No.01/2008] was filed to get the decree in term of impugned judgment executed and in view of settlement reached between the parties, the said execution petition has been withdrawn.
