By way of the instant writ petition, the Petitioner seeks issuance of directions to the Respondents for refunding court fees amounting to INR 2,88,600/-, which was purchased by her for obtaining Letters of Administration. It is averred that the physical certificate of court fees, bearing certificate No. DLCTO215K2306P068, had been collected by the clerk of the counsel on behalf of the Petitioner, however, the same has inadvertently been misplaced, and remains unused. 2.

In the aforenoted circumstances, the Petitioner requested the Respondents to refund the court fees to enable the Petitioner to obtain fresh court fees. However, this request was rejected as there is no provision to permit such a refund. Counsel for Respondents, on instructions, states that the refund of court fees is now possible only upon the Petitioner furnishing certain necessary documentation.

Accordingly, the following directions are issued: (i) The Respondents shall, within a period of two weeks from today, indicate to the Petitioner the necessary documentation required to be furnished for refund of the court fees.

(ii) The Petitioner shall, within a period of two weeks thereafter, furnish all necessary documentation. Thereafter, the Respondents shall refund the court fees to the Petitioner.
