% 27.04.2016 (1) The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.2276/2015 under Sections 354/506/509/34 IPC and Section 8 and 12 POCSO Act registered at Police Station Mehrauli. Status report is on record.
(2) I have heard the learned counsel for the parties and have examined the file.
The petitioner is in custody since 13.10.2015. Initially the FIR was registered under Sections 506/509 IPC and Section 12 POCSO Act. During investigation Section 354/34 IPC BAIL APPLN. 45/2016
and Section 8 POCSO Act were added.
Upon completion of investigation, a charge-sheet has already been filed against the present petitioner.
It is informed that co-accused Naim is absconding and non-bailable warrants have been issued against him. On the previous date of hearing, it was informed that the statement of the prosecutrix has not yet been recorded.
Order sheet dated 18.04.2016 has been placed on record whereby despite issuance of process, the victim and her father were not available at the given address. It was informed that they have shifted to some unknown place. The matter was adjourned to 11.07.2016. Impugned order records that the victim's father had appeared before the Court and did not desire any action. (3) Considering the facts and circumstances of the case, the petitioner is admitted to bail on his furnishing personal bond in the sum of `50,000/-with one surety in the like amount to the satisfaction of the Trial Court. The petitioner shall not contact the prosecutrix and shall not intimidate her or her family members in any manner. (4) The application stands disposed of.
