This Petition under Section 29A(5) of the Arbitration and Conciliation Act, 1996, has been filed by the Petitioner for extending the mandate of the Arbitrator in the Arbitration proceedings which are going on between the parties.

Material on record indicates that the disputes have arisen between the parties under the Lease Deed dated 05.12.2005. It is stated that the Petitioner has approached this Court by filing the Petition under Section 11 of the Arbitration and Conciliation Act, 1996 seeking appointment of an Arbitrator to adjudicate upon the disputes between the parties. the Supreme Court of India as Sole Arbitrator to adjudicate upon the disputes which have arisen between the parties under the Lease Deed dated 05.12.2005.

Material on record further indicates that the pleadings were completed on 26.08.2022. It is stated that the mandate of the Tribunal is being extended from time to time and the last such extension was granted by this Court vide Order dated 14.02.2024. It is stated that the mandate of the Arbitral Tribunal is going to expire on 24.02.2025, therefore, the Petitioner has approached this Court for extension of mandate.

It is stated that the matter is at the stage of recording of expert evidence.

Accordingly, this Court is inclined to extend the mandate of the Arbitral Tribunal till 31.12.2025, so that the award can be pronounced and no further extension of time would be required by the Tribunal. 6.

The Petition is disposed of, along with the pending applications, if any.
