Petitioners seek quashing of FIR No.335/2018 dated 15.08.2018, registered at P.S. Fatehpur Beri, for commission of offences under Sections 498A/406/34 of IPC, 1860, based on one settlement which took place long back i.e. on 12.03.2020.

It is not clear as to why the petition has been filed after such an inordinate delay, particularly, when the parties got divorce by mutual consent way back on 27.07.2022.

When asked, learned counsel for the petitioners submitted that respondent No.2 has not been appearing before the learned Trial Court either where the case is fixed for Prosecution Evidence. 4.

Fact, however, remains that the present quashing is based on settlement and since respondent No.2 is not present, this Court cannot come to the rescue of petitioners.

After hearing arguments for some time, learned counsel for the petitioners seeks to withdraw the present petition with liberty to file afresh, in case the petitioners are able to contact respondent No.2, and in case she is willing to come forward for the purposes of making statement for quashing of the present petition.

The petition is, accordingly, disposed of as not pressed. Liberty, as prayed, is granted.
