O R D E R
% 06.02.2018 Submissions have been made on behalf of either side. Through the status report already on the record, dated 30.01.2018, submitted by the SHO, PS Vijay Vihar, whereafter, the investigation is indicated to have been entrusted to the CBI vide directions dated 20.12.2017 of the orders of the Hon'ble the Acting Chief Justice, it has been brought forth through the submissions made on behalf of either side that the applicant has been incarcerated for a period of 46 days. It has been submitted during the course of the submissions made, as also submitted by the Investigating Officer, DSP R.K. Jha that the applicant is not required for custodial interrogation though her presence is required for the investigation in the case. It has also been submitted in reply to a specific court query on behalf of the CBI that there are no previous adverse antecedents against the applicant.
In view thereof, subject to the applicant joining the investigation as and when required, not intimidating the witnesses, not tampering with the evidence and not leaving the country, the applicant is allowed to be released on bail on her furnishing a bail bond in the sum of Rs. 50,000/- with one surety of like amount to the satisfaction of the learned Trial Court. The investigation having since been entrusted to the CBI and the FIR is now RC:DST/2018/S/0003/STF.
