The present petition has been filed by the petitioner under Article 227 of the Constitution of India, 1950 read with Section 62 of the Information Technology Act, 2000, assailing the judgment dated 19th November, 2025 passed by the Telecom Disputes Settlement & Appellate Tribunal, New Delhi in Cyber Appeal No. 4/2013, whereby the appeal filed by the petitioner has been dismissed.

Learned Counsel for the respondents appeared on advance notice and accepts notice.

At the outset, learned Counsel for the petitioner submits that the present petition has been inadvertently filed under Article 227 of the Constitution of India, whereas the appropriate remedy available to the petitioner is by way of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. a statutory appeal under Section 62 of the Information Technology Act, 2000. 5.

After some arguments, learned Counsel for the petitioner also seeks permission to withdraw the present petition with liberty to avail the remedy of statutory appeal, as provided under law.

Accordingly, the present petition is dismissed as withdrawn with liberty as prayed for, in accordance with law. All the rights and contentions of the parties are left open. Pending application(s), if any, also stand disposed of. 7.
