The present Application has been filed under Order I Rule 10 of the Civil Procedure Code, 1908 ["CPC"], on behalf of the Applicant who claims to be the owner of 18.75% share of the property which is under dispute.

For the reasons as stated in the Application, the same is allowed.

Accordingly, Rolexco Buildtech Pvt. Ltd. is impleaded as Respondent No. 4 to the present Petition.

The present Petition has been filed under Section 27(5) read with Section 17(2) of the Arbitration and Conciliation Act, 1996 ["Act"] for initiation of contempt proceedings against the Respondent/Contemnor for wilful disobedience of the Order dated 23.01.2026 passed by the Arbitral Tribunal.

Mr. Apoorv Kurup, learned Senior Counsel appearing on behalf of the Respondent nos. 1-3, at the outset, submits that they have not violated the directions of the learned Arbitrator and have not in any manner sought to restrain the Petitioner from entering into the premises.

Notwithstanding, he proposes to undertake that they will not in any manner seek to restrain either the Petitioner or newly impleaded Respondent No. 4.

Since learned Senior Counsel appearing on behalf of the Respondent nos. 1-3, on instructions, gives his categoric undertaking that there will be no interference with the enjoyment of the said property by either the Petitioner or newly impleaded Respondent no. 4, nothing further survives in the present Petition to adjudicate. 9.

The said statement made on behalf of Respondent nos. 1-3 is taken on record.
