The present appeal under Section 96 of the CPC, seeks the following prayers: - "The appellant, therefore, most respectfully prays that this Hon'ble Court may be pleased to allow the appeal of the appellant and set aside the Judgment and Decree dated 30.09.2010 passed by the Court of Shri Pitamber Dutt, A.DJ., Delhi in C.S. No 22112006. Any other or further relief which this Hon'ble Court deems fit & proper under the circumstances of the case may also be awarded." 3.

None appears on behalf of the appellant today. 4.

Perusal of the record would reflect that Court notice was issued to the parties by the learned Predecessor Benches of this Court vide orders dated 06.12.2024 and 08.05.2025, and reports with regard to the same reflect that the appellant has passed away and the respondent is not residing at the given address.

It is pertinent to note that no application has been filed for bringing on record the legal heirs of the deceased appellant. The period of 90 days for bringing on record the legal heirs has expired, as also the period for setting aside the abatement, which is 60 days thereafter. 7.

In view of the above, the present appeal stands abated and disposed of accordingly.
