% 25.04.2026 (The matter has been taken up today, as 03.03.2026 was declared as a holiday.) 1.

The instant petition is for the following reliefs: "A) Issue a writ of mandamus or any other appropriate writ order or direction in the nature thereof, thereby directing the respondents not to obstruct, interfere in the construction work of roof of two rooms constructed on the land comprising in Khasra No. 56//23 (0-16) village Bakoli, Delhi owned by the petitioner in compliance of order dated 19.11.2019 passed by respondent no.l/SDM.

B) Issue a writ of mandamus or any other appropriate writ order or direction in the nature thereof, thereby directing to the respondent no. 1/SDM Alipur, Delhi for not taking any coercive/punitive action against the construction of two rooms and one open shelter, constructed by the petitioner as per the tenns of order dated 19.11.2019 passed. bY. SDM, on the land comprising in Khasra No. 56//23 (0-16) village Bakoli, Delhi owned by the petitioner."

carry out any constructions beyond the scope and conditions specifically stimulated in the permission letter dated 19.11.2019. 3.

The respondentno. 1 inits counter affidavit vide paragraph no. 5 has also taken the position that subject to the said compliance, they shall not carry out any demolition. Paragraph no. 5 of the said counter affidavit is extracted as under:

"5. That this office undertakes that no demolition action shall be initiated or carried out in respect o f the structures situated on the land bearing Khasra Nos. 56/23-24 and 6 1/3, subject to the strict condition that the applicant does not undertake any construction beyond the scope and conditions expressly stipulated in the permission letter dated 19-11-2019. Any deviation there from shall be viewed as a violation of the extant norms and may invite appropriate action as per law." 4.

It is, thus, seen that the grievance of the petitioner is mitigated. 5.

Accordingly, the instant petition along with pending application stands disposed of.
