The present writ petition has been filed seeking a direction to the respondent/MCD to demolish and prevent unauthorised cutting taking place at plot No. B-86A, Khasra No.31/7/2, Bharat Vihar, Kakrola, New Delhi. 2.

It is stated that the unauthorised construction is going on at the outskirts of the colony of the petitioner society and in the nearby area, facing the petitioner society. If the unauthorised construction is continued, then the common road of the petitioner society will be affected and unnecessarily crowded. The same shall create a hindrance in the traffic management and parking problem on the road of the petitioner society. 3.

Along with the petition, the petitioner has placed on record photographs to show the construction being carried out at subject plot. 4.

that the aforesaid property has been inspected on 2nd February, 2026 and the construction was found to be at a very initial stage. A work stop order has also been issued on 2nd February 2026 to SHO, PS: Sector-17, Dwarka, New Delhi 5.

A copy of the aforesaid work stop order has been handed over in Court and the same is taken on record.

Accordingly, the SHO, PS: Sector-17, Dwarka, New Delhi is directed to act in terms of the aforesaid work stop order. 7.

Accordingly, the petition stands disposed of. 8.

In the event the petitioner has any further grievance, the petitioner would be free to avail the remedies as available in law. 9.

All rights, contentions and legal remedies of the owner/occupier shall remain protected.
