O R D E R

This is an application filed under Section 528 of BNSS, 2023 seeking modification of the bail conditions as mentioned in para 7 (a) and (e) of the order dated 29.01.2025.

The condition nos. 7 (a) and (e) of the order dated 29.01.2025 reads as under:

"7.....

(a) The petitioner shall furnish a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) with 01 local surety in the like amount, to the satisfaction of the concerned Jail Superintendent;

.....

(e) The petitioner shall not leave the NCR of Delhi and Country without permission of the concerned Court and surrender his passport, if any, at the time of release before the concerned jail authorities."

Ms. Sinha, learned counsel for the petitioner states that the petitioner is unable to arrange a local surety and will provide a surety of his father or any other family member. Further, the petitioner is not a resident of Delhi and will be residing at his permanent address i.e. Jhajjar, Haryana. 4.

For the said reasons, Issue notice. Mr. Lao, learned Standing Counsel accepts notice and has no objection to the application being allowed. 5.

Accordingly, the bail conditions as mentioned in para 7 (a) and (e) of the order dated 29.01.2025 are hereby modified. 6.

The petitioner shall furnish a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) and one surety bond of his father or any other family member in the like amount, to the satisfaction of the concerned Jail Superintendent. Further, the petitioner will reside at his permanent address in Village Dariyapur, P.O. Badli, P.S. Badli, District - Jhajjar, Haryana. 7.

All other terms and conditions of the order dated 29.01.2025 remain unchanged.

The present application is allowed and disposed of in the aforesaid terms.
