Even on the last two occasions, no one has been appearing on behalf of the petitioner.

Counsel for the MCD points out that the action taken report, filed on 05th April 2024, as per which sealing orders were passed on 15th February 2024, and the unauthorized construction was sealed on 04th March 2024. 4.

The private owner has filed an appeal before the Appellate Tribunal MCD against demolition order. However, it is informed that there is no stay. 5.

Counsel for the MCD states that the MCD shall take action in accordance with law pursuant to the sealing order and the demolition program The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. which was scheduled for 15th February 2024, but could not take place due to non-availability of police force.

The SHO, PS Netaji Subhash Place is directed to provide adequate support to the MCD for carrying out the demolition. 7.

The demolition will be carried out, if there is no restraint order by the Appellate Tribunal MCD in this regard.

Petition is disposed of with the aforesaid directions, with liberty to the petitioner to approach this Court in case there is any continued infraction. 9.
